Personal Information Collection Notice — Contestants

If you are a contestant or have applied to become a contestant in combat sports contests in Western Australia (‘you’), the Combat Sports Commission (‘we’) may collect your personal information for the following purposes:

• to assess and decide your application or renewal for registration as a contestant (including whether you are a fit and proper person, understand your duties under the Combat Sports Act 1987 (WA), are of the prescribed age, are medically and physically fit to the extent required, and have completed required online education);
• to verify your identity, confirm your contact details, issue your certificate of registration or renewal of registration, and to maintain a register of contestants as required under the Combat Sports Act 1987 (WA);
• to record your pre‑contest weigh-in weight and results of a pre/post‑contest medical examination for determining if an approved medical practitioner has certified you fit to compete in a contest or not;
• to oversee contests, pre-contest weigh-ins and pre/post contest medical examinations (for example, verifying contestants named on permits and contest cards, verifying and recording your weight and results in your and your opponent’s contestant record book) and to ensure contests comply with relevant rules and regulations;
• to send you notices about registrations, renewals, expiries, conditions, restrictions, health, safety and integrity requirements and other Combat Sports Commission information (e.g. SMS/email reminders);
• to engage with you for the purpose of obtaining your feedback on our guidelines, policies, procedures, training and other services and regulatory practices relating to combat sports;
• to process fees and reconcile payments for your registration, renewal or for issuing a replacement contestant record book;
• to assess your applications for therapeutic use exemptions to use prohibited substances or methods;
• to verify if you are registered in any other jurisdiction for which there may be mutual recognition or clearance of registration available; 
• to publish a register of suspensions and disciplinary actions which will include the categorised reason for a suspension, the date the action/suspension was issued and timeframe or condition which must occur before the action/suspension ends; and
• to operate disciplinary processes relating to your compliance with your obligations under the Combat Sports Act 1987 (WA).  

We may collect your personal information from:

• you directly, via our online registration portal or education modules, application/renewal forms, emails and scanned or uploaded documents (including photo ID, passport‑style photo, serology report and certificate of fitness);
• medical practitioners who complete forms relating to your fitness/serology or medical clearance, pre‑and post‑contest medical examination, and concussion referral/assessment/clearance;
• WA Police, who may provide information to help assess whether you are a fit and proper person as authorised under the Combat Sports Act 1987 (WA);
• promoters’ permit applications and contest documentation (e.g. contest cards that match you and your opponent, weight class, contest records and your trainer/second) and any additional information we require to decide those applications or your bout;
• another state or territory combat sports regulatory authority to  verify if you are registered in any other jurisdiction for which there may be mutual recognition or clearance of registration;
• our appointees/members and approved medical practitioners at pre-contest weigh‑ins, pre/post-contest medical examinations and contests, who inspect your contestant record book and record prescribed information (e.g.  your weigh-in weight, medical certifications, contest results);
• our payment service provider, who provides us with payment confirmation details (e.g. payer name, amount, partially obscured credit card number and card expiry date) for payment reconciliation purposes; and
• any permit holder, contestant, industry participant or other person participating or involved in conducting the contest pursuant to our power to issue a notice under the Combat Sports Act 1987 (WA) requiring they provide any information relevant to a contest.      

We may disclose your personal information to:

• contest permit holders (promoters) as it relates to your eligibility to participate in their contest;
• WA police as is necessary for us to make requests under the Combat Sports Act 1987 (WA) for information held by them in order to determine if you are a fit and proper person;
• the Department of Creative Industries, Tourism and Sport (CITS), which provides services to us which enable us to carry out our functions. These services include those relating to staffing, physical premises, information management, information technology infrastructure, cyber security, freedom of information and legal services. As such, your personal information may be held by CITS, however, it will not be used or accessed other than for the purposes of enabling us to carry out our functions; and
• medical practitioners approved to conduct your pre-contest medical examination, approved ringside medical practitioners overseeing your contest and post-contest medical examination and your chosen healthcare practitioner for any concussion referral/assessment/clearance requirements.

If you do not provide your personal information:

• you may not be eligible to be registered, or have your registration renewed, where that information is required to process your registration or is otherwise material to the outcome of your application;
• you may be liable for financial penalties under the Combat Sports Act 1987 (WA) if you provide information or your failure to provide information results in your application or any matter relevant to your eligibility for registration, being false or misleading in a material way; and
• you may be liable for financial penalties under the Combat Sports Act 1987 (WA) where you do not provide information relevant to a contest which we request in writing under that Act.

Personal Information Collection Notice — Industry Participants

• to assess and decide your application or renewal for registration as an industry participant (including whether you are a fit and proper person, understand your duties under the Combat Sports Act 1987 (WA), are of the required age for your role, are medically and physically fit to the extent required, and have completed required online education);
• if you are a promoter, to assess and decide your application for a permit and contest card, to conduct a contest; 
• to assess and verify your qualifications, experience and training as they relate to your competence and suitability for the category of industry participant you have applied for; 
• to verify your identity, confirm your contact details, issue your certificate of registration or renewal of registration, and to maintain a register of industry participants as required under the Combat Sports Act 1987 (WA);
• to oversee contests, pre-contest weigh-ins and pre/post contest medical examinations (for example, verifying industry participants named on permits and contest cards) and to ensure contests comply with relevant rules and regulations;
• to send you notices about registrations, renewals, expiries, conditions, restrictions, health, safety and integrity requirements and other Combat Sports Commission information (e.g. SMS/email reminders);
• to engage with you for the purpose of obtaining your feedback on our guidelines, policies, procedures, training and other services and regulatory practices relating to combat sports;
• to process fees and reconcile payments for your registration, renewal or permit to conduct a contest;
• to verify if you are registered in any other jurisdiction for which there may be mutual recognition or clearance of registration available; 
• to publish a register of suspensions and disciplinary actions which will include the categorised reason for a suspension, the date the action/suspension was issued and timeframe or condition which must occur before the action/suspension ends; and
• to operate disciplinary processes relating to your compliance with your obligations under the Combat Sports Act 1987 (WA).

• promoters’ permit applications, contest cards and any additional information we require to decide those applications;
• another state or territory combat sports regulatory authority to verify if you are registered in any other jurisdiction for which there may be mutual recognition or clearance of registration;

Personal Information Collection Notice — Healthcare Practitioners

• to ensure that health, fitness and medical related information collected about recipients is accurate and based on the opinion of suitably qualified healthcare practitioners; 
• to verify your identity and qualification, confirm your contact details and check your Australian Health Practitioner Regulation Agency (AHPRA) registration details;
• to oversee contests, pre-contest weigh-ins and pre/post contest medical examinations (for example, verifying name of medical practitioner nominated on permits and contest cards) and to ensure contests comply with relevant rules and regulations;
• if you are a medical practitioner approved by us, to ensure that you comply with your obligations under the Combat Sports Act 1987 (WA); and
• if you are a medical practitioner approved by us, to send you notices about Combat Sports Commission information (e.g. change to medical forms or processes) or to seek further clarification to any medical information you have provided.   

• you directly, via emails and scanned or uploaded documents;
• forms (approved by us) that you complete and sign before and after contests (e.g. certificate of fitness and serology clearance, pre  and post contest medical examination, therapeutic use exemption and concussion assessment/clearance forms) and entries you make in contestant record books; 
• public registers of healthcare practitioners for the purpose of verifying your qualifications and obtaining your AHPRA registration number; 
• documentation submitted through the contest permit application process where your details may be provided to us as the medical practitioner engaged by a promoter;
• any permit holder, contestant, industry participant or other person participating, conducting or involved in a contest you were engaged at, pursuant to our power to issue a notice under the Combat Sports Act 1987 (WA) requiring they provide any information relevant to a contest.

We may disclose your personal information to:

• contest permit holders (promoters) as it relates to your eligibility to participate in their contest; and
• the Department of Creative Industries, Tourism and Sport (CITS), which provides services to us which enable us to carry out our functions. These services include those relating to staffing, physical premises, information management, information technology infrastructure, cyber security, freedom of information and legal services. As such, your personal information may be held by CITS, however, it will not be used or accessed other than for the purposes of enabling us to carry out our functions.

If you do not provide your personal information:

• we may be unable to verify your opinions on the medical, health or fitness status of the relevant contestant as those of a suitably qualified healthcare practitioner, which may affect the ability of the contestant or referee to be registered or participate in a contest;
• you may not be eligible to be approved as a medical practitioner for the purposes of the Combat Sports Act 1987 (WA); and
• you may be liable for financial penalties under the Combat Sports Act 1987 (WA) if you provide information or your failure to provide information is false and misleading  in a material way or if you are the approved medical practitioner for a contest and do not certify contestants’ record books.
